Expert remarks in Strasbourg on AI at the European Court of Human Rights

Veronika Fikfak was invited to give expert remarks at the Council of Europe's exchange of views with the Drafting Group on the Use of New Technologies by the European Court of Human Rights (CCDH). Drawing on six years of work on automation in human rights adjudication, she set out four recommendations: that the finality and evolutive nature of European human rights adjudication demand extra caution; that discretionary questions such as admissibility or predicting violations should not be entrusted to AI; that the "human in the loop" is no automatic safeguard, since automation bias and over-reliance can amplify error; and that the Court should carry out a human rights impact assessment and tell applicants when automation has been used in their case.
